Corruption and Crime Commission

Brenton was at the Corruption and Crime Commission for several years as a Lawyer, and for a period, a Senior Assessor.

 

He provided CCC investigators legal advice and training regarding the extent of their powers under various statutes to support the CCC’s serious misconduct and unexplained wealth investigations and reviewed warrant applications under various statutes.

 

He appeared as Counsel Assisting in a number of serious misconduct investigations, involving corruption, excessive use of force, and theft of intellectual property and also appeared in criminal confiscation proceedings in the Supreme Court.

Serious Misconduct Investigations

Corruption - Perth Lawyer

As a Lawyer, Brenton appeared as Counsel Assisting the Commission, where he examined witnesses using the coercive powers under the Corruption, Crime and Misconduct Act 2003 (WA) (CCM Act). He also reviewed countless warrants under:

 

  • the CCM Act;

  • Telecommunications (Interception and Access) Act 1979 (Cth);

  • Surveillance Devices Act 1998 (WA); and 

  • Criminal Property and Confiscation Act 2000 (WA),

 

to ensure compliance with the relevant legislative framework.

As a Senior Assessor, Brenton prepared assessment reports from notifications received by members of the public and notifying authorities regarding serious misconduct. He assessed each allegation to make recommendations on whether to proceed to an investigation, take no action, or refer the matter back to the notifying authority. 

Unexplained Wealth

Brenton also worked on unexplained wealth matters, where he appeared in the Supreme Court to obtain freezing orders, including variations, and production orders under the Criminal Property Confiscation Act 2000.

 

He also assisted with preparing for examinations under the CPC Act to secure unexplained wealth declarations.
